Xarelto multidistrict litigation (MDL) 2592 consolidates more than 2,800 lawsuits against Bayer AG and Janssen Pharmaceuticals. 40 bellwether cases have been selected in the MDL. The bellwether cases are meant to be representative of everything that will be covered in the individual cases. MDL is different from a class action in that the individual lawsuits remain separate, but certain aspects can be combined. MDL streamlines the process and is often used when there is a large number of very similar lawsuits.
Selecting Xarelto Bellwether Cases
U.S. District Judge Eldon Fallon originally asked the plaintiffs and defendants to work together in selecting the representative cases, but they could not agree on the criteria, so that judge set the criteria as follows:
- 10 cases selected by the plaintiffs
- 10 cases selected by the defendants
- 20 cases chosen at random by the court
Of those 40 cases the geographical distribution was to be:
- 20 from the Eastern District of Louisiana
- 2 from Texas
- 4 from Mississippi
- 7 from states of the plaintiffs’ choosing
- 7 from states of the defendants’ choosing
Ultimately, the breakdown of chosen locations was a follows:
- Louisiana – 19
- Mississippi – 4
- Texas – 2
- Tennessee – 2
- North Carolina – 2
- Alabama – 1
- Colorado – 1
- California – 1
- Georgia – 1
- Illinois – 1
- Ohio – 1
- Nevada – 1
- New York – 1
- Utah – 1
- Virginia – 1
- West Virginia – 1
