On December 21, 2010, Congress passed the Food Safety Modernization Act (Read it here: PDF). The new law gives the U.S. Food and Drug Administration (FDA) the ability to initiate food recalls, requires the agency to conduct a minimum number of inspections of food processing facilities, and holds importers responsible for the safety of the food which they bring into the country. FSMA does not apply to meat and poultry products.
FDA Recalls
FSMA gives the FDA the power to issue mandatory recalls on food products. The FDA food recalls you may be familiar with are voluntary recalls announced by the FDA and typically made at the FDA’s request. Food producers rarely refuse to comply with and FDA recall request, but now, if they do, the FDA will be able to force the recall.
Inspections
The FDA already had the authority to inspect food processing facilities, but it rarely does so. Before FSMA there was no requirement for how often the FDA conducts the inspections. The version of FSMA which passed requires the FDA to inspect high risk facilities at least once in the first five years after the law goes into effect, and once every three years after that. Low risk facilities must be inspected at least once every seven years. The original version of the law would have required that high risk facilities be inspected at least once a year.
Imported Foods
The new law requires importers to verify the safety standards of the foreign companies that supply their products. They must certify that their food products meet the same safety standards required for production in the U.S. The FDA is to issue guidance to importers for developing their certification systems. The FDA is also required to establish offices in at least five countries that export foods to the U.S.
Monitoring the Food Supply
Under FMSA, food companies will be required to submit sales and food shipment records so that products can be tracked through the food supply chain, hopefully making it easier to find the source of the problem when outbreaks of food-borne illness occur. New programs will be established to track produce and processed foods.
Whistleblower Protection
Before FMSA, food industry workers had no legal protection from retaliation by their employers when they reported violations of safety regulations or if they refused to participate in illegal activities. FMSA establishes protections for employees who report violations of the Federal Food, Drug, and Cosmetics Act (FFDCA). These protections only cover workers who report FDA violations, not U.S. Department of Agriculture (USDA) violations.
Indentifying Risks
Food companies will be required to submit detailed reports identifying risks within their facilities and systems, creating a plan for preventing contamination, and a plan for handling problems when they occur. The FDA will have 18 months to conduct a study and create a report which includes the types and sizes of food facilities and the risks associated with each size and type.
Tester-Hagan Amendment: Exempting Small Farms
The Tester-Hagan amendment played a large role in the passage of FMSA. The strongest opposition to the bill was due to the impact it could have on small farms and food producers who would be overburdened by paperwork and expenses associated with the new law. Under the Tester-Hagan amendment small farms are exempt from most of the new regulations created by FMSA.
The Tester-Hagan amendment applies to farms that sell within 275 miles of their farm or within state lines and to farms who make at least half of their money from direct-to-consumer sales and make only $500,000 a year or less.
The Vote on FMSA
The House of Representatives passed H.R. 2751: FDA Food Safety Modernization Act, with 298 votes in favor of passage and 119 against the bill. There were two votes of “present” and 15 members did not vote. The bill needed 280 votes to pass. Here is the breakdown by state:

Bill cassidys person answering the phone told me that they were against this bill I passed out handbills against this bill and I go to check his vote and here it says that he voted in favor of the bill.
I am done with both parties you can all burn in hell. I am registering indipendent asap. Bigger government forcing the little guy out of business in favor of larger corporations. No wonder we are not being allowed to see the readings on the EPA.Gov website they are trying to cover this up to save some company tied to the radiation leakage in Japan. We don’t have a legal justice system it is a legal justice industry owned and controlled by big business.
